At the request of Marta Suplicy, senators approve PEC (Proposed Amendment to the Constitution) on culture

Senator, recently named Minister of Culture, introduced the process. The proposal articulates public policy in the area and now goes to the enactment.

The plenary of the Senate approved late on 12 September, the proposed amendment to the Constitution that provides for the creation of the National Culture. The proposal was approved in two shifts, with no dissenting vote. There were 56 votes in favor on the first ballot and 54 on the second one. Passed on by the Parliament, the bill was reported by Senator Suplicy (PT-SP), who has assumed the management of the Ministry of Culture.

The bill states that the Union, states and municipalities can articulate joint policies in the sector in order to democratize the management of public policies in the country. The proposal will now be forwarded for promulgation.

The proposal was passed after the agreement announced by the spokesman of the government leader in the Senate, Eduardo Braga (PMDB-AM). In plenary, Marta asked colleagues to approve the proposal.

"I want to thank the trust [..] I know what was done today is not usual and I thank the unanimous support of the Senate as this is my last speech in the senate," said the senator. Earlier, she received congratulations, praise and support from colleagues in the plenary session.

Presented in 2005 in the Parliament by Rep. Paul Pepper (PT-RS), the proposal came to the Senate in July and was practically stopped, ready to be voted on in plenary, since in late August it had been approved in the Commission of Constitution and Justice.

The text approved by the Senate also provides for the definition of principles that must be assured, such as an universal access to cultural goods and services, fostering the production and autonomy of federated entities.

The regulation of the system, however, will depend on specific legislation, both federal as well as state and municipalities. In the states, the Federal District and the municipalities, should organize their own legal systems.
