The judge in the Odyssey case recognizes the rights of Spain over las Mercedes.

Federal Judge Mark Pizzo in Tampa, as in the case of Spanish rule against the company Odyssey Marine Exploration, has decided in the first instance that the company should return to Spain all the coins and other objects from the wreck Nuestra Senora de las Mercedes within a maximum of 10 days.

The decision, which cements the precedent established in the case of the Juno and La Galga, in a way that recognizes clear and that "mutual respect among nations requires that the location of the wreck Our Lady of Mercy with all people who perished on that fateful day remains unchanged. International law recognizes the solemnity of the place where lying and the sovereign interests of Spain in preservation. "The decision also points out that American courts have no jurisdiction, ie, can not come to judge the claims made by the Republic of Peru and descendants.

The decision is a report and recommendation must now be reviewed by a senior judge. This means that within 10 days that the Odyssey is to return the coins, does not begin until the judge accepts the decision of Senior Judge Pizzo. Furthermore the company Odyssey, descendants or Peru, have a period of 10 days to claim the decision to Pizzo.

In any case, this judge's decision is an extraordinary step for our country and their right and obligation to protect the heritage from any kind of disturbance and illegal exploitation. This is our law of Protection of Historical Heritage and the UNESCO Convention on Protection of Underwater Cultural Heritage, which entered into force in January this year.
